Welcome to Cheap Gains ("the App"), operated by Siloware, a sole proprietorship of Domenic Pond ("we," "us," "the Company"). By using the App, you agree to these terms. If you don't agree, please don't use the App.
1. What Cheap Gains Does
Cheap Gains helps you generate grocery shopping lists aimed at hitting a protein target within a budget, using estimated pricing data, and offers optional Premium features including barcode-scanned nutrition data, store price comparisons, and saved shopping plans.
2. Not Nutritional, Medical, or Financial Advice
Important: Cheap Gains is a planning tool, not a source of professional advice.
- Protein and calorie targets are based on general formulas (bodyweight and stated goal) and are not personalized medical or nutritional guidance. Consult a doctor, registered dietitian, or other qualified professional before making significant changes to your diet, especially if you have any health condition.
- Grocery prices shown in the App are estimates based on general averages, not live, guaranteed, or store-specific prices, except where explicitly noted as coming from a live data source. Actual prices at your store may differ.
- Barcode/product data is sourced from Open Food Facts, a community-maintained open database, and may be incomplete, outdated, or inaccurate.
3. Accounts & Premium Subscriptions
- Some features require a paid Premium subscription, billed on a recurring basis through Stripe.
- By subscribing, you authorize us (via Stripe) to charge your payment method on a recurring basis until you cancel.
- You can cancel anytime; your Premium access continues through the end of the current billing period. We do not offer prorated refunds for partial billing periods, except where required by law.
- We may change Premium pricing with advance notice. Continuing your subscription after a price change means you accept the new price.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to interfere with, hack, or disrupt the App or its backend services
- Scrape, reverse-engineer, or resell App data or functionality without permission
- Use automated tools to abuse rewarded-ad or free-tier limits
We reserve the right to suspend or terminate access for violations of these terms.
5. Advertising
The free version of the App may display advertising from third-party ad networks, including optional "watch an ad to unlock" rewarded ads. We are not responsible for the content of third-party ads.
6. Third-Party Services
The App relies on third-party services (including Stripe, the Kroger Developer API, and Open Food Facts) that we don't control. We're not responsible for outages, inaccuracies, or changes in these services that may affect App functionality.
7. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to accuracy, reliability, or fitness for a particular purpose.
8. Limitation of Liability
To the maximum extent permitted by law, Siloware, a sole proprietorship of Domenic Pond is not liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to grocery spending decisions, dietary outcomes, or reliance on price estimates.
9. Changes to These Terms
We may update these terms from time to time. We'll update the "Last updated" date when we do. Continued use of the App after changes means you accept the updated terms.
10. Governing Law
These terms are governed by the laws of Connecticut, without regard to conflict-of-law principles.
